Guidelines and Responsibilities in use of the HENRY DONEGER ASSOCIATES, INC website
1. The User has been furnished with a Log in ID and Password to the Site. The password may not be disclosed by the User to any persons, and the User will be bound by these Guidelines and Responsibilities. Henry Doneger Associates, Inc ("Doneger"), at any time, may immediately de-activate a Password.
2. Doneger owns all right, title and interest in and to all the Content (meaning all data of any type on the Site) or has a license to use such Content as used in the Site; and User may not (i) copy, transmit, modify, distribute, publish, assign, sublicense, create any derivative work from, or otherwise use any of the Content except as expressly permitted by Doneger; or (ii) disassemble, translate, reverse-engineer, reverse-compile, decompile or make any derivative work from any software or code contained within the Content. The Content located on the Site is owned by or licensed to Doneger and is protected by applicable U.S. and international copyright, trademark, trade secret and other intellectual property laws.
3. The User does not acquire any right, title or interest in or to any of the Content of the Site as a result of its using the Site or otherwise. Doneger reserves the right, at its sole discretion and at any time and without notice, to restrict User's access to any part of the Site.
4. Doneger shall have exclusive ownership rights in all Content of the Site, including (i) the right to compile, organize, sell and otherwise distribute such information for any legal purpose and (ii) the right to reproduce, modify, distribute, or create derivative works from, and otherwise use such material anywhere, at any time, in any medium and for any purpose. Doneger has the right, in its sole discretion without notice and without any liability, to remove any Content.
5. User agrees that it will not post on the Site any Content without the approval of Doneger.
6. User expressly acknowledges that Doneger is entitled to gather information about use of the Site, and User authorizes Doneger to compile, distribute, sell and otherwise use such information for any legal purpose, including the provision of such information to apparel manufacturers and others participating in the Site.
7. THE SITE AND ALL CONTENT THEREON ARE PROVIDED TO USER "AS IS" AND "AS AVAILABLE" FOR ITS USE, WITHOUT WARRANTIES BY DONEGER OF ANY KIND, EXPRESS OR IMPLIED. USER'S USE OF THE CONTENT, THE SITE, AND OF THE INTERNET ARE AT USER'S SOLE RISK.
8. User acknowledges that its sole remedy in the event of a dispute with Doneger is termination of its use of the site.
9. Doneger reserves the right to amend these Guidelines and Responsibilities at any time and from time to time.
